PRIVACY NOTICE AND COOKIE POLICY

NOTICE ON THE PROCESSING OF PERSONAL DATA
pursuant to Article 13 of Regulation (EU) 2016/679

This notice is provided pursuant to Article 13 of Regulation (EU) 2016/679 (“GDPR”) and describes the methods of processing personal data of users who browse the website www.consolatoalbanianapoli.it or who contact the Controller through the contact details provided on the website.

1. Data Controller

The Data Controller is Giuseppe Lettieri, with registered office in Via Vittorio Colonna 14, 80121 Naples, Italy, and digital domicile at the e-mail address info@consolatoalbanianapoli.it.

2. Categories of data processed

The Controller may process the following categories of personal data:

  • identification and contact data, such as name, surname, e-mail address, telephone number, residence or domicile address, where provided by the data subject;

Legal basis: Art. 6(1)(f) GDPR, i.e., the Controller’s legitimate interest in ensuring the security, availability and integrity of the website and related systems.

b) receiving, managing and responding to information requests or communications sent by the user
Legal basis: Art. 6(1)(b) GDPR, when processing is necessary to take pre-contractual steps at the request of the data subject, or Art. 6(1)(f) GDPR, for the Controller’s legitimate interest in responding to communications received.

c) sending informational communications, updates, initiatives, projects, surveys, research and promotional communications relating to the Controller’s activities and services
Legal basis: Art. 6(1)(a) GDPR, i.e., the data subject’s consent.

d) complying with legal obligations, regulations or orders issued by competent Authorities, as well as establishing, exercising or defending legal claims
Legal basis: Art. 6(1)(c) GDPR and, where applicable, Art. 6(1)(f) GDPR.

4. Nature of data provision

The provision of data necessary for browsing and website security is essential for the use of web services.

The provision of data for sending contact or information requests is necessary in order to receive a response. Failure to provide such data may make it impossible to process the request.

The provision of data for informational and promotional purposes is optional. Failure to provide consent does not affect website browsing or the ability to contact the Controller.

5. Methods of processing

Personal data is processed using paper, electronic and telematic tools, according to logic strictly related to the purposes indicated and in compliance with the principles of lawfulness, fairness, transparency, minimisation, accuracy, integrity and confidentiality.

The Controller adopts appropriate technical and organisational measures to protect personal data from unauthorised access, loss, destruction, unlawful disclosure or misuse.

6. Recipients of personal data

Personal data may be processed, within the limits of the purposes indicated above, by:

  • persons authorised by the Controller;
  • providers of IT, telematic, hosting, website maintenance, e-mail management and technical support services, appointed, where necessary, as data processors pursuant to Article 28 GDPR;
  • entities or Authorities to whom data must be communicated by law or by order of the Authority.

Personal data is not disseminated.

7. Transfer of data to third countries

Personal data is generally processed within the European Economic Area.

If, for technical or organisational reasons, it becomes necessary to transfer data to third countries or international organisations, the Controller will ensure that the transfer complies with Articles 44 et seq. GDPR and with the safeguards required by applicable law.

8. Data retention period

Personal data is retained for the time strictly necessary to achieve the purposes for which it was collected and, in particular:

  • data processed to manage contact and information requests is retained for no longer than 12 months from the conclusion of the request, unless required otherwise for the protection of the Controller’s rights;
  • data processed for informational and promotional purposes is retained until consent is withdrawn and, in any case, for no longer than 12 months from the last meaningful interaction;
  • data processed to comply with legal obligations is retained for the period required by applicable law;
  • technical browsing data is retained for the time strictly necessary to ensure website functioning and security.

9. Rights of the data subject

The data subject may exercise, in the cases provided for by the GDPR, the rights set out in Articles 15 et seq., including the right to:

  • obtain confirmation as to whether or not personal data concerning them is being processed and, if so, access the data and the information required by law;
  • obtain the rectification of inaccurate data or the completion of incomplete data;
  • obtain the erasure of personal data in the cases provided for by Article 17 GDPR;
  • obtain restriction of processing in the cases provided for by Article 18 GDPR;
  • receive personal data in a structured, commonly used and machine-readable format and, where technically feasible, have it transmitted to another controller;
  • object at any time to processing carried out on the basis of the Controller’s legitimate interest;
  • object at any time to processing for direct marketing purposes;
  • withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

10. Complaint to the Supervisory Authority

The data subject has the right to lodge a complaint with the Italian Data Protection Authority or to bring proceedings before the competent courts if they believe that the processing of their personal data violates applicable law.

11. Automated decision-making processes

The Controller does not carry out processing involving automated decision-making, including profiling, pursuant to Article 22 GDPR.
